An assault is defined as any unwelcome physical touch, and can include a grab, push, slap or punch. Even the threat of these actions can be called assault in the eyes of the law.
In Ontario, the majority of assaults are domestic (often between spouses.)
Family relationships are complex, and it’s common for arguments to spiral out of control. It’s often the neighbours, fearing for the couple’s safety, who call the police. Once police are on the scene, they can arrest one or both of you, regardless of you or your partner’s intention.
To be clear, it’s not up to you or your spouse to decide who gets arrested. That decision is made by the police and it is based on how they see the situation.
An assault arrest has serious consequences. For example, conditions may be set that prevent you from returning home, that limit access to your children, and even prohibit you from living or working within a certain distance to your family.
The important thing to understand is that, with an assault charge, it is not up to the complainant to drop charges; only the police can make that decision. Unfortunately, once charges are laid, the province usually tries to prosecute.
The harsh reality is that assault charges, if not handled properly, can destroy your family unit and cause intense trauma to every member of your inner circle.
